It is known as <strong>&quot;judicial efficiency law&quot;<\/strong>, seeks to introduce two reforms, one in terms of <strong>organizational <\/strong>and another <strong>procedural<\/strong>, with the aim of improving resource management and streamlining the workload in courts and tribunals. Since <strong><a href=\"http:\/\/escalanteperez.com\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\">Escalante &amp; P\u00e9rez Lawyers<\/a><\/strong>, we tell you the key aspects of this reform.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Objective of the Judicial Efficiency Law<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The main objective of the <strong>judicial efficiency law<\/strong> is that justice be more <strong>modern<\/strong>, <strong>accessible <\/strong>and <strong>sustainable<\/strong>In this sense, the <strong><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2025-76\" target=\"_blank\" rel=\"noreferrer noopener\">Organic Law 1\/2025<\/a><\/strong> It aims to solve problems in the structure of the Spanish justice system, such as the overcrowding of courts and tribunals; <strong>territorial inequality<\/strong> in access to justice and the lack of technological resources.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1000\" height=\"667\" src=\"http:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-1-2025.jpg\" alt=\"The judicial efficiency law will come into force on April 3.\" class=\"wp-image-1218\" srcset=\"https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-1-2025.jpg 1000w, https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-1-2025-300x200.jpg 300w, https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-1-2025-768x512.jpg 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">On the one hand, the law aims to <strong>modernize the organization of the judicial system<\/strong>, through the creation of Courts of First Instance. It also seeks, as we mentioned, to reduce territorial inequality by opening new <strong>Justice Offices in the municipalities<\/strong> wherever necessary. Furthermore, the new law aims to promote digitalization, making justice more agile and accessible.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New requirement for mandatory negotiation before filing a lawsuit<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Organic Law 1\/2025 introduces a requirement as to <strong>procedurality <\/strong>It refers to. This is a procedure that must be done prior to the <strong>filing of the claim<\/strong> and consists of the <strong>negotiation <\/strong>either <strong>attempt at negotiation<\/strong> between the parties, a requirement that is known as <strong>MASC <\/strong>or Alternative Means of Conflict Resolution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new law of procedural efficiency seeks to <strong>the parties reach an agreement<\/strong> through a process of <strong>mediation<\/strong>, <strong>conciliation <\/strong>either <strong>arbitration<\/strong>, so that they can resolve their conflicts. Something that would undoubtedly reduce the volume of proceedings carried out in the courts. These are the <strong>prerequisites<\/strong> to file the claim and which are found in the articles <strong>7, 9 and 10 <\/strong>of the aforementioned law:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide, along with the demand, the <strong>documentation <\/strong>that proves having carried out or attempted a prior negotiation.<\/li>\n\n\n\n<li>In case of negotiation, a <strong>document signed by the parties<\/strong> which includes your identification data, that of the professionals who helped with the negotiation, the date, the object of the controversy, the dates of the meetings and the <strong>responsible declaration<\/strong> that the parties have participated, in good faith, in the negotiation process.<\/li>\n\n\n\n<li>In case there has been a <strong>attempt at negotiation<\/strong>, but if no agreement has been reached; or if there has been negotiation, but it is not possible to provide the document, any document proving that the other party has received the request or invitation for negotiation may be attached. It is also possible, where appropriate, to provide the <strong>proposed agreement<\/strong>.<\/li>\n\n\n\n<li>It is possible to file the claim after sending the request or invitation for negotiation, only after <strong>30 calendar days <\/strong>from the date of receipt of the request and provided that the first meeting to reach an agreement has not been held or if there is no written response. The <strong>within one year<\/strong>, from this date, in order to file the claim.<\/li>\n\n\n\n<li>In the event that a <strong>negotiation meeting<\/strong> must have elapsed <strong>three months<\/strong>, from the first meeting and without any agreement. The deadline can be reduced provided the parties communicate with each other. <strong>in writing<\/strong>, ending the meetings without agreement. There is, at this point, a <strong>exception<\/strong>. If after a meeting, one of the parties sends the other a specific agreement proposal and in case there is no written response, in a <strong>within 30 days of receipt<\/strong>, the claim may be filed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is not necessary for the parties to have the <strong>assistance of a lawyer <\/strong>during negotiations, but it is mandatory when it comes to the <strong><a href=\"http:\/\/escalanteperez.com\/en\/tramites\/\" target=\"_blank\" rel=\"noreferrer noopener\">drafting a binding offer<\/a><\/strong>In these cases, the lawyer must prepare them as long as the amount of the matter to be resolved is <strong>greater than 2,000 euros<\/strong>.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img decoding=\"async\" width=\"1000\" height=\"571\" src=\"http:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-eficiencia.jpg\" alt=\"The new law seeks to reduce the workload through MASC\" class=\"wp-image-1217\" srcset=\"https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-eficiencia.jpg 1000w, https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-eficiencia-300x171.jpg 300w, https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/ley-eficiencia-768x439.jpg 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The law of judicial efficiency specifies that it will not be necessary to have a <strong>attempt at negotiation in certain cases<\/strong>, such as precautionary measures, preliminary proceedings, civil protection of fundamental rights, exchange trials, etc. It is important to highlight that if the counterparty is <strong>unlocated <\/strong>and it is not possible to notify you of the negotiation request, then the same procedure as in cases of non-location by the court must be applied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, as we already mentioned, the <strong>judicial efficiency law <\/strong>will come into force on April 3. If a claim is filed before this date, it will not be necessary to <strong>prior negotiation<\/strong> (or attempt at it). But, if the demand is<strong> after the date<\/strong> in question, then it will be mandatory to make an attempt at negotiation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Alternative dispute resolution methods in the Judicial Efficiency Act<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important aspects of the judicial efficiency law is that it seeks <strong>promote extrajudicial solutions <\/strong>such as mediation and arbitration. This measure, in particular, will free up the workload of the courts and reduce legal costs. In addition,<strong>encourages citizen participation<\/strong> in conflict resolution through the aforementioned mechanisms. This measure will come into effect on January 1, 2026. As we mentioned, these are the <strong>MASC<\/strong>What are these alternative conflict resolution mechanisms?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mediation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>mediation <\/strong>It is an ADR in which two or more parties voluntarily attempt to reach an agreement with the intervention of a <strong>mediating person<\/strong>The mediator&#039;s objective is to facilitate dialogue and a <strong>impartial agreement<\/strong>, as well as a neutral attitude, but without making any proposals. The agreement reached through mediation is confidential.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conciliation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The conciliation is carried out by a <strong>expert <\/strong>(conciliator), who has <strong>technical or legal knowledge<\/strong> related to the subject of the conflict. The conciliator is the one who helps the parties reach an agreement <strong>agreement<\/strong>, because it is allowed to do so <strong>proposals <\/strong>to end the dispute. It should be noted that conciliation can be <strong>public <\/strong>either <strong>private <\/strong>and can carry it out:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>justices of the peace<\/strong>, when it comes to matters of lesser importance <strong>6,000 euros<\/strong>.<\/li>\n\n\n\n<li>The <strong>lawyers <\/strong>of the Administration of Justice, in accordance with the Law of Voluntary Jurisdiction.<\/li>\n\n\n\n<li><strong>Notaries<\/strong>, according to the Notarial Law.<\/li>\n\n\n\n<li><strong>Property Registrars<\/strong>, as provided by the Mortgage Law.<\/li>\n\n\n\n<li>It can be carried out by judges and lawyers of the Administration of Justice, during the process. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Negotiation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the <strong>negotiation<\/strong>, the parties may reach an agreement directly, either between themselves or with the assistance of a legal advisor or <strong>lawyer<\/strong>. In the event of an agreement being reached, <strong>the controversy ends<\/strong>, but if this is not the case, then the parties can go to court.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img decoding=\"async\" width=\"1000\" height=\"667\" src=\"http:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/eficiencia-procesal.jpg\" alt=\"The parties should attempt to reach an agreement before filing a lawsuit.\" class=\"wp-image-1216\" srcset=\"https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/eficiencia-procesal.jpg 1000w, https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/eficiencia-procesal-300x200.jpg 300w, https:\/\/escalanteperez.com\/wp-content\/uploads\/2025\/03\/eficiencia-procesal-768x512.jpg 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Collaborative law<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The law on judicial efficiency also establishes that the parties may avail themselves of a <strong>collaborative law process<\/strong>In this case, they may be accompanied by a <strong>practicing legal professional<\/strong> and registered in a Bar Association, accredited in collaborative law and with the intervention, if applicable, of <strong>neutral third parties experts<\/strong> on the subject matter of the controversy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the collaborative process, the lawyers must<strong> draft a final report<\/strong>The document will contain information about the parties, the professionals involved, the sessions held and the <strong>agreements adopted<\/strong>Issues on which agreement could not be reached will also be mentioned.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Confidential binding offer<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Either party may propose a <strong>confidential binding offer<\/strong> to the other. Once this offer is expressly accepted, <strong>both parties are obliged to comply with it<\/strong>. The acceptance of the offer has a character <strong>irrevocable<\/strong>. The offer, as well as its <strong>acceptance<\/strong>, must record the <strong>identity of the offeror<\/strong>, its effective receipt and the date on which the receipt takes place, as well as the content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The binding offer is of a <strong>confidential <\/strong>and, if applicable, <strong>rejected <\/strong>either <strong>not expressly accepted<\/strong> on the other hand, within the period of<strong> a month<\/strong>, will lapse. When this occurs, the requesting party may bring the corresponding action before the competent court. In this case, it will only be necessary <strong>submit the offer <\/strong>to the other side.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Opinion of an independent expert on the law of judicial efficiency<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Another of the alternatives proposed by the law of judicial efficiency is the <strong>opinion of an independent expert<\/strong>. Here the parties reach an agreement to <strong>appoint an expert<\/strong> in the matter to issue an independent report of a <strong>technical<\/strong>If the parties agree with the report, they can reach an agreement and end the conflict.
